These Terms of Sale govern purchases made through Darsons.fr. By placing an order, you agree to these Terms together with our Terms of Service, Privacy Policy, Shipping Policy and Return & Refund Policy.

2. Products

We make reasonable efforts to ensure that product descriptions, specifications and images on Darsons.fr are accurate.

Colours and appearance may vary slightly depending on the customer's screen or device.

Product availability and specifications may change from time to time. Any such changes do not affect orders already accepted, except where required or permitted by applicable law.

Nothing in these Terms limits the consumer's statutory rights relating to product conformity or defects.

3. Prices

All prices displayed on Darsons.fr are in euros (€) and include applicable taxes where required by law.

Darsons currently benefits from the VAT exemption applicable under Article 293 B of the French General Tax Code.

Shipping charges and any other additional costs applicable to an order will be clearly displayed before the customer completes the purchase.

The total amount payable will be shown at checkout before payment is confirmed.

4. Orders and Contract Formation

When you place an order, you submit an offer to purchase the products selected.

After receiving your order, we will send an order confirmation to the email address provided.

The contract is concluded in accordance with the applicable checkout and confirmation process.

We may refuse or cancel an order where there is a legitimate reason, including payment problems, suspected fraud, obvious pricing errors or product unavailability.

If an order is cancelled after payment has been received, any amount due to the customer will be refunded in accordance with applicable law.

5. Payment

Payment is due in full when the order is placed.

Available payment methods are displayed during checkout.

Payments are processed through the payment services available on our Shopify store. Payment information is handled in accordance with the applicable payment provider's security and privacy practices.

6. Delivery

Delivery information, estimated delivery times and shipping charges are provided during the purchasing process and in our Shipping Policy.

Darsons remains responsible for fulfilling the order and complying with applicable delivery obligations, even when third-party carriers or fulfilment providers are used.

If a delivery deadline applicable to the order is not respected, the customer retains the rights provided under applicable French and EU consumer law.

7. Right of Withdrawal

For purchases covered by French and EU consumer law, consumers generally have a 14-day right of withdrawal from receipt of the goods, without having to provide a reason, subject to statutory exceptions.

To exercise this right, the customer must clearly inform Darsons of the decision to withdraw within the applicable period.

Following notification of withdrawal, the goods must generally be returned within 14 days.

Unless otherwise required by law or agreed by Darsons, the customer may be responsible for the direct cost of returning goods following a change-of-mind withdrawal, provided this information was communicated before purchase.

8. Returns and Refunds

Returns and refunds are handled in accordance with our Return & Refund Policy and applicable consumer law.

Where a valid statutory withdrawal is exercised, Darsons will reimburse the amounts required by law, including the applicable initial standard delivery charge where required.

Where permitted by law, reimbursement may be delayed until the returned goods are received or the customer provides proof that the goods have been returned.

9. Legal Guarantees

Products purchased from Darsons benefit from the mandatory legal guarantees applicable under French law, including:

  • Legal guarantee of conformity (garantie légale de conformité);

  • Legal guarantee against hidden defects (garantie des vices cachés).

These legal guarantees apply independently of any commercial warranty that may be offered.

Nothing in these Terms limits or excludes any mandatory statutory consumer rights.

10. Damaged, Defective or Incorrect Products

If you receive a damaged, defective or incorrect product, please contact us at darsons168@gmail.com with your order number and details of the issue.

We may request photographs or other reasonable information to assess the problem.

Depending on the circumstances and applicable law, the available remedy may include repair, replacement, price reduction or refund.

We will investigate the issue with the relevant carrier or fulfilment provider and take the appropriate action required under applicable law.

12. Liability

Darsons is responsible for its obligations as a professional seller under applicable French and EU consumer law.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

In particular, these Terms do not limit statutory consumer rights relating to product conformity, defects, delivery, withdrawal or refunds.

13. Consumer Complaints and Mediation

If you have a complaint, please contact Darsons first so that we can attempt to resolve the matter amicably.

If the dispute cannot be resolved directly, consumers may have the right to use a consumer mediation procedure in accordance with applicable French law.

14. Applicable Law

These Terms of Sale are governed by French law.

If you are a consumer residing in another European Union country, this choice of law does not deprive you of mandatory consumer protections applicable in your country of residence.

Any dispute will be handled by the competent courts in accordance with applicable law and mandatory consumer jurisdiction rules.
