TERMS OF SERVICE

Last updated: October 2, 2026

OVERVIEW

Welcome to Darsons.fr. The terms “we”, “us” and “our” refer to Darsons.

Darsons operates this online store and website, including the information, content, features, tools, products and services made available through it (the “Services”). Our online store is powered by Shopify.

These Terms of Service (“Terms”), together with our Privacy Policy, Return & Refund Policy, Shipping Policy and other policies displayed on our website, govern your use of our Services and purchases made through Darsons.fr.

By accessing our website or placing an order, you agree to these Terms. Nothing in these Terms limits or excludes any mandatory rights available to consumers under applicable French or European Union law.

1. ACCESS AND USE OF OUR STORE

You may use our website only for lawful purposes and in accordance with these Terms.

When providing information to us, including when placing an order, you agree to provide information that is accurate, current and complete.

You are responsible for maintaining the confidentiality of any account credentials associated with our Services.

2. PRODUCTS

We make reasonable efforts to display and describe our products accurately.

However, product colours and appearance may vary slightly depending on your screen, device settings or other technical factors.

Product descriptions, availability and specifications may be updated where necessary.

We may discontinue products or limit quantities where reasonably necessary, subject to applicable consumer law.

Nothing in this section affects your statutory rights, including your rights relating to product conformity and defective products.

3. ORDERS

By placing an order through Darsons.fr, you submit an offer to purchase the products in your order.

After receiving your order, we may send an acknowledgement or confirmation to the email address you provided.

We reserve the right to refuse or cancel an order where there is a legitimate reason, including suspected fraud, incorrect pricing, payment problems or product unavailability.

If we cancel an order after payment has been received, amounts due to you will be refunded in accordance with applicable law.

Please review your order information carefully before completing your purchase.

4. PRICES, TAXES AND PAYMENT

Prices displayed to consumers on Darsons.fr are shown in euros (€) and include applicable taxes where required by law.

Darsons currently benefits from the VAT exemption regime applicable under Article 293 B of the French General Tax Code, where applicable.

Delivery charges and any other additional charges payable by the customer will be communicated before the customer confirms the order.

The total amount payable will be displayed during checkout before payment is completed.

Prices may change from time to time, but a change will not affect an order already accepted, except where permitted or required by applicable law.

You agree to provide accurate and authorised payment information when placing an order.

5. SHIPPING AND DELIVERY

Available delivery options, applicable delivery charges and estimated delivery times are communicated during the ordering process or through our Shipping Policy.

Delivery times provided on our website are estimates unless a specific binding delivery date has been expressly agreed.

We will fulfil our delivery obligations in accordance with applicable French and EU consumer law.

Darsons remains responsible for delivery as required by applicable consumer law. We do not transfer responsibility to the customer merely because a third-party carrier is used to deliver the order.

If an order is delayed, lost or arrives damaged, please contact us at darsons168@gmail.com so that we can investigate and provide an appropriate solution in accordance with applicable law.

For additional information, please review our Shipping Policy.

6. RIGHT OF WITHDRAWAL

Where applicable under French and EU consumer law, consumers purchasing online generally have the right to withdraw from their purchase without giving a reason within 14 days from the date they, or a third party designated by them other than the carrier, receive the goods.

To exercise your right of withdrawal, you must inform us of your decision through a clear statement before the withdrawal period expires.

After notifying us of your withdrawal, the goods must be returned within the period required by applicable law.

Unless otherwise stated or required by law, the customer may be responsible for the direct cost of returning products following a change-of-mind withdrawal, provided this information was communicated before purchase.

Certain statutory exceptions to the right of withdrawal may apply depending on the nature or condition of the product.

Full details are provided in our Return & Refund Policy.

Nothing in these Terms limits your statutory withdrawal rights.

7. RETURNS AND REFUNDS

Returns, refunds and exchanges are handled according to our Return & Refund Policy and applicable consumer law.

For a valid statutory withdrawal, we will reimburse the payments required by applicable law, including the cost of the least expensive standard delivery option where legally required.

We may withhold reimbursement until we receive the returned goods or you provide evidence that the goods have been sent back, where permitted by law.

Refunds will generally be issued using the same payment method used for the original transaction unless otherwise agreed.

Please consult our Return & Refund Policy for complete details.

8. LEGAL GUARANTEES

Customers benefit from mandatory statutory consumer protections applicable to their purchases.

Where applicable, these include the legal guarantee of conformity (garantie légale de conformité) and the legal guarantee against hidden defects (garantie des vices cachés).

These statutory guarantees apply independently of any additional commercial guarantee that may be offered.

Nothing in these Terms excludes, restricts or replaces these mandatory legal rights.

9. DAMAGED, DEFECTIVE OR INCORRECT PRODUCTS

If you receive a damaged, defective or incorrect product, please contact us as soon as reasonably possible at darsons168@gmail.com.

Please provide your order number and information that allows us to understand the issue. We may reasonably request photographs or other information where necessary to assess the problem.

Depending on the circumstances and your statutory rights, an appropriate remedy may include repair, replacement, price reduction or refund.

Your statutory consumer rights remain unaffected.

Third-party services are governed by their own terms and policies.

We are not responsible for independent third-party websites or services outside our control, except where applicable law provides otherwise.

We aim to keep Darsons.fr accessible and accurate, but we cannot guarantee that the website will always operate without interruptions or technical errors.

We may temporarily suspend or modify parts of the website for maintenance, security or operational reasons.

Nothing in this section excludes liability or obligations that cannot legally be excluded under applicable consumer law.

16. LIMITATION OF LIABILITY

To the extent permitted by applicable law, Darsons will not be responsible for indirect or consequential losses that were not reasonably foreseeable.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

In particular, nothing in these Terms affects mandatory consumer rights available under French or European Union law, including rights relating to product conformity, hidden defects, delivery and other statutory protections.

17. CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to our Services, business practices or applicable legal requirements.

The current version will be available on Darsons.fr and the “Last updated” date will be revised when appropriate.

Changes will not retroactively remove mandatory consumer rights relating to purchases already made.

18. GOVERNING LAW

These Terms are governed by French law.

If you are a consumer residing in another European Union country, this choice of law does not deprive you of mandatory consumer protections available to you under applicable law.

Nothing in these Terms prevents a consumer from exercising rights relating to jurisdiction that cannot lawfully be restricted by contract.
